Welcome to GeoTrack. These Terms of Service ("Terms") govern your access to and use of the GeoTrack mobile application ("App" or "Service") provided by Software Shark Tech Pvt Ltd ("we," "us," or "our").

By downloading, installing, or using the GeoTrack application, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

Note: These Terms may be updated from time to time without prior notice. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

1. Acceptance of Terms

By accessing or using GeoTrack, you confirm that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • All information you provide is accurate and truthful

2. Description of Service

GeoTrack is a GPS tracking application that allows users to:

  • Record and track their routes and movements
  • Save routes to their device storage
  • Attach photos to recorded routes
  • Share routes with other users via internet connectivity
  • Access location-based features and services

The Service is provided free of charge on an "as is" and "as available" basis.

3. User Account and Registration

Account Creation

While GeoTrack may not require account creation for basic features, if registration is required:

  • You must provide accurate and complete information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized access

Account Termination

We reserve the right to suspend or terminate your account at any time if:

  • You violate these Terms of Service
  • You engage in fraudulent or illegal activities
  • Your actions harm other users or our Service

4. User Responsibilities and Conduct

By using GeoTrack, you agree to:

  • Use the Service only for lawful purposes
  • Not interfere with or disrupt the Service or servers
  • Not attempt to gain unauthorized access to any part of the Service
  • Not upload or transmit viruses, malware, or harmful code
  • Not use the Service to harass, abuse, or harm others
  • Not violate any applicable local, state, national, or international law

Prohibited Activities

You may NOT use GeoTrack to:

  • Stalk, harass, or track others without their consent
  • Collect personal information about other users
  • Engage in any illegal surveillance activities
  • Upload inappropriate, offensive, or harmful content
  • Reverse engineer, decompile, or disassemble the application
  • Remove or modify any copyright, trademark, or proprietary notices

5. Privacy and Data Collection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy.

By using GeoTrack, you consent to:

  • Collection of location data for route tracking
  • Storage of routes and photos on your device
  • Use of device permissions as outlined in our Privacy Policy

6. Permissions and Device Access

GeoTrack requires certain device permissions to function properly:

  • Location (GPS) – Essential for tracking and recording routes
  • Storage – Required to save routes and data locally
  • Camera/Photos – Allows you to attach images to routes
  • Internet – Enables route sharing and online features

You may revoke these permissions at any time through your device settings, but this may limit functionality.

7. Intellectual Property Rights

Our Rights

All content, features, functionality, software, and design of GeoTrack are owned by Software Shark Tech Pvt Ltd and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

Your Content

You retain ownership of any photos, routes, or content you create using GeoTrack. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service.

8. Third-Party Services

GeoTrack integrates with third-party services including:

  • Google Play Services
  • Google Maps API (if applicable)
  • Other analytics and service providers

Your use of these third-party services is subject to their respective terms and policies. We are not responsible for the practices or content of third-party services.

9. Disclaimers and Limitations

Service Availability

We strive to provide reliable service, but we do not guarantee that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • Results obtained from the Service will be accurate or reliable
  • Any errors or defects will be corrected
  • The Service will meet your specific requirements

GPS Accuracy

GPS tracking accuracy may be affected by:

  • Weather conditions
  • Terrain and physical obstacles
  • Device hardware limitations
  • Network connectivity issues

We are not responsible for inaccuracies in location tracking or route recording.

Use at Your Own Risk

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • We shall not be liable for any loss of profits, data, or goodwill
  • Our total liability shall not exceed the amount you paid to use the Service (which is zero for free services)

This limitation applies regardless of the legal theory upon which the claim is based.

11. Indemnification

You agree to indemnify, defend, and hold harmless Software Shark Tech Pvt Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Service

  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

12. Safety and Responsible Use

Distracted Use Warning

Do not use GeoTrack while:

  • Operating a vehicle or machinery
  • In situations requiring your full attention
  • Engaging in activities where distraction could cause harm

Location Sharing Safety

Be cautious when sharing your location or routes:

  • Only share with trusted individuals
  • Be aware of privacy implications
  • Consider security risks before making routes public

13. Modifications to Service

We reserve the right to:

  • Modify or discontinue the Service at any time
  • Change features or functionality
  • Impose limits on certain features
  • Update the application through app store updates

We will make reasonable efforts to notify users of significant changes.

14. Termination

By You

You may stop using the Service at any time by uninstalling the application from your device.

By Us

We may terminate or suspend your access immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Threats to Service security or integrity
  • Other conduct we deem inappropriate

Upon termination, your right to use the Service will immediately cease.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through:

  1. Good faith negotiations between parties
  2. Mediation, if negotiations fail
  3. Jurisdiction of courts in Nepal

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Software Shark Tech Pvt Ltd regarding the use of GeoTrack and supersede any prior agreements.
